Development applications

The introduction of the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009 means that from 1 July 2010, Queensland Urban Utilities will have a role in the development assessment process for water and waste water issues.

However, for three years (up to 30 June 2013), the local Councils of Brisbane, Ipswich, Lockyer Valley, Scenic Rim and Somerset will continue to manage the entire development assessment process (including the water and waste water components on behalf of Queensland Urban Utilities).

What this means for me

Customers continue to lodge development applications (including payment of application fees) with their local council in the usual manner.

To ensure seamless service delivery to customers, Councils will continue to be the single point of contact for all development applications. Where Councils require specialist advice in relation to water and waste water components of a development application, Council will liaise with Queensland Urban Utilities.

Councils will be the assessment manager for all aspects of development applications and will make decisions on water and wastewater issues on behalf of Council and Queensland Urban Utilities where required.

Land Use Planning

Councils will continue to set the strategic land use planning direction through their planning scheme.

Queensland Urban Utilities will provide water and wastewater advice to councils on land use planning and infrastructure charging.

Queensland Urban Utilities will meet Council’s land use planning requirements through the delivery of water and wastewater infrastructure.

What this means for me

There is no change to existing arrangements for customers.

Infrastructure Agreements

From 1 July 2010, Queensland Urban Utilities becomes responsible for Infrastructure Agreements related to water and waste water network infrastructure.

What this means for me

Depending on your circumstances, Infrastructure Agreements will be managed in different ways. Further information on these circumstances is provided below:

Infrastructure Agreements executed before 1 July 2010

Queensland Urban Utilities will assume the rights and obligations for the water and waste water components of all current infrastructure agreements between third parties and the local Councils of Brisbane, Ipswich, Lockyer Valley, Scenic Rim and Somerset which have been formally executed up to and including 30 June 2010.

These infrastructure agreements do not need to be executed again with Queensland Urban Utilities. State legislation provides for the transfer of the water and waste water components of all current local Council infrastructure agreements to Queensland Urban Utilities on 1 July 2010.

Councils will continue to administer these agreements on behalf of Queensland Urban Utilities. Accordingly, enquiries regarding these agreements should be directed to Council in the first instance.

Infrastructure Agreements previously being negotiated with the local Council but not executed by 30 June 2010

From 1 July 2010, all infrastructure agreements for water and wastewater network infrastructure will need to be agreed and executed with Queensland Urban Utilities. Where formal negotiations have previously occurred with the local Council, Queensland Urban Utilities will work with the local Council to provide a seamless transition for customers and where appropriate enter into an infrastructure agreement.

Infrastructure Agreements requested after 1 July 2010

From 1 July 2010, Queensland Urban Utilities will negotiate and execute all new infrastructure agreements for water and wastewater network infrastructure. The local Councils will continue to negotiate and manage infrastructure agreements for all other network infrastructure.

Where separate infrastructure agreements are required with Queensland Urban Utilities and the local Council (e.g. for multiple networks), Queensland Urban Utilities and the local Council will coordinate negotiations to ensure both infrastructure agreements compliment each other and can be practically implemented.
